SERVICE AGREEMENT
SRM Termite & Pest Control ("the Company") Agreement
This Terms and Conditions Agreement ("Agreement") is between SRM Termite & Pest Control, a pest management company offering pest control services ("the Company"), and you, the client ("Client"), collectively referred to as the "Parties."
1. Service Provision (“the Services”)
The Company provides pest control Services aimed at the management and control of pests. The Services include, but are not limited to, the assessment, treatment, and prevention of pest infestations.
2. Service Limitations
The Company endeavours to provide the highest level of service; however, the nature of pest control is such that an absolute guarantee of 100% eradication of pests cannot be offered. Pest control is understood to be a management tool used to control pest populations and for the purpose of minimising the risk and extent of infestations.
3. Client Acknowledgment
The Client acknowledges that pest control Services are a means of managing, not eradicating pests. Therefore, the Client understands and accepts that some pests may continue to be present even after treatment.
4. Client Responsibilities
The Client agrees to adhere to the recommendations and instructions provided by the Company's technicians. This includes, but is not limited to, follow-up treatments, regular inspections, and taking preventative measures as advised.
5. Routine Inspections
The Client is responsible for organising regular, routine inspections as part of an ongoing pest management strategy. The Company should be immediately contacted if the Client observes any unusual pest activity, including signs of termites.
6. Non-Liability of the Company
We prioritise the well-being of our customers and their pets, but it is important to acknowledge that achieving a completely pest-free environment is not always feasible. Consequently, any losses or health issues that may arise due to pest-related concerns cannot be attributed to our Services, and we cannot be held responsible for them. Our primary objective is to reduce and control pests to the best of our abilities, but we cannot assume liability for any associated consequences to people or pets.
7. Termite Inspection
Termite inspections do not ensure the detection of all termites, as several factors may limit the effectiveness of the inspection. A primary limitation is restricted access to certain areas.
8. Limitation of Guarantees
Specifically, with regards to termite control and pests that may cause harm, such as biting, blood-sucking insects, or bugs that release neurotoxins, the Company cannot guarantee 100% eradication. The Client understands that these pests pose unique challenges and that the Company is not liable for any resulting problems to humans, animals, or property.
9. Pest Harbourage Reduction
The Client is expected to take proactive measures to minimise potential harbourage areas for pests. This includes maintaining cleanliness, removing clutter, and other actions as recommended by the Company's technicians.
10. Bookings
To avoid a $55 last-minute cancellation fee, please notify us of any booking cancellations at least 24 hours before the scheduled time. This advance notice helps us manage our schedules smoothly and fill any openings. Similarly, a $55 cancellation fee is charged for pre-bookings that are cancelled to cover our administrative expenses.
11. HVO Offers
HVO imposes additional charges for invalid warranty claims. If, during a visit, no pest activity is detected or the client has not adhered to our recommendations for maintaining proper hygiene and cleanliness, the warranty claim will be considered invalid. Any additional costs will be discussed before treatment is carried out.
12. Indemnification
The Client agrees to indemnify and hold harmless the Company from any claims, damages, or expenses resulting from the Client's failure to comply with the terms of this Agreement.
13. Service Termination
This Agreement is effective upon the Client's acceptance of Services from the Company and will continue until terminated by either party with written notice. Termination will not affect the Client's obligation to pay for Services rendered prior to termination.
14. Dispute Resolution
Any disputes arising under this Agreement shall first be attempted to be resolved through mutual negotiation. If the Parties are unable to resolve the dispute, mediation may be sought before any legal action is pursued.
15. Governing Law
This Agreement takes effect, is governed by, and shall be construed in accordance with the laws from time to time in force in New South Wales, Australia. The Parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
16. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.
17. Entire Agreement
This document constitutes the entire agreement between the Parties regarding its subject matter and supersedes all prior agreements and understandings, both written and oral, between the Parties.
18. Amendment
This Agreement may only be amended or modified by a written document executed by both the Company and the Client.
19. Acceptance
The Client's use of the Company's Services constitutes acceptance of these terms and conditions.
